Michelle Monroe is a senior attorney in the Litigation practice group of Theodora Oringher, PC.  She has a range of trial and appellate experience in state and federal courts, litigating hospital privileging matters, whistleblower retaliation and related torts, and fraud and abuse issues.  She also works with the firm’s commercial business litigation practice and has gained substantial experience litigating claims of misappropriation of trade secrets, breach of contract, unfair competition, interference with economic advantage, among others.

Her experience also includes providing regulatory counsel to health systems, hospitals, medical staffs, physicians, medical groups, and other players in the healthcare sector dealing with challenging transactional, investigatory, and regulatory issues, such as the corporate practice of medicine, HIPAA, the Stark Law, and state and federal anti-kickback and self-referral regulations.  Additionally, she has represented clients in medical staff peer review matters and administrative law proceedings before the California Medical Board.

She is the Treasurer and Secretary of the Orange County Bar Association – Health Law Section.  She also serves on the Board of the California Academy of Attorneys for Health Care Professionals, a statewide health care attorney organization focused on physician peer review and discipline, state agency licensing and discipline, and other regulatory and administrative issues affecting health care providers.

Prior to joining Theodora Oringher, Ms. Monroe earned her J.D. and Certificate in Dispute Resolution from Pepperdine University School of Law.  While in law school, she served as the Senior Articles Editor of the Dispute Resolution Law Journal and was the Legal Research and Writing Teaching Assistant for first-year law students.  Ms. Monroe also served as a law clerk for Justice Victoria Chavez of the Second District, California Court of Appeal.

Ms. Monroe’s pro bono work includes representing children with disabilities and their parents in disputes with various school districts on behalf of the Pepperdine Special Education Advocacy Clinic.

She has authored a number of articles including The Medicare Appeals Crisis: Why Mediation Is the Medicine, Vol. XVI, Pepp. Dispute Resolution L. Journ., 61-82 (2016) and What happens when a party is added after an offer?, L.A. Daily Journ., June 29, 2015, at 5.
