Andrew Breidenbach is a Senior Attorney in the Century City office of Theodora Oringher. Andrew is a counselor, negotiator, and litigator, who combines deep experience in trial and appellate litigation with a background in economic policy to achieve creative, efficient solutions for his clients. Public and private entities alike turn to Andrew for considered advice and effective defense regarding highly sensitive issues and existential legal risks that involve difficult public relations and political elements.

For example, Andrew defended the Orange County District Attorney’s Office in litigation arising from the so-called Orange County “Jailhouse Informant Scandal.” With a tenacious belief in his client’s position, Andrew was able to cut through the contentious rhetoric that clouded the case and bring the true facts to light while protecting the critical prerogatives of the Office. Ultimately, Andrew negotiated a unique settlement that was extremely favorable to District Attorney’s Office.

Currently, Andrew serves as outside general counsel to the Roman Catholic Diocese of Orange County, as well as its schools and parishes. In that role, Andrew responds to the complex day-to-day issues that arise from the educational, construction, charitable, and administrative operations of the Diocese. As outside general counsel, Andrew also advises the Diocese in its development and implementation of policies and procedures aimed at ensuring the safety of all persons within the Diocese. Further, Andrew serves the Diocese as lead trial counsel in an array of sensitive and complex legal matters, ranging from construction disputes to business torts to personal injury lawsuits.

Having completed trial- and appellate-level federal clerkships, Andrew understands what cases need and what judges want, and he is able to develop and present complex issues in a way that will resonate with juries, judges, mediators, and clients. He is also a seasoned commercial litigator, having represented plaintiffs and defendants in a broad array of complex, high-value matters, including cross-border commercial disputes, insurance coverage cases, patent and copyright actions, and disputes arising from mergers and acquisitions.

After graduating from Harvard Law School, Andrew clerked for Judge Percy Anderson on the U.S. District Court for Central District of California and Judge Dennis Jacobs on the U.S. Court of Appeals for the Second Circuit. Prior to joining Theodora Oringher, Andrew was a litigation associate at Reed Smith LLP in Philadelphia and Holwell Shuster & Goldberg LLP in New York.

Representative Matters
    • Serving as outside general counsel to the Roman Catholic Diocese of Orange County, handling all legal matters on behalf of the Diocese, including without limitation employment advice, handbook advice, counseling on the development and implementation of policies and procedures regarding sexual misconduct, managing litigation counsel, intellectual property protection, general risk advice, contract negotiation, etc.
    • Serving as lead trial counsel for the Roman Catholic Diocese of Orange in cases alleging child sexual abuse by current and former employees of the Diocese.
    • Lead trial counsel representing the Orange County District Attorney in civil suit brought by American Civil Liberties Union alleging that the District Attorney’s use of confidential custodial informants violated state and federal laws. After continuous discovery period where Andrew defended the depositions of the most senior OCDA personnel, Andrew negotiated highly favorable, sui generis settlement that avoided any admission of liability or payment of attorneys’ fees to plaintiffs.
    • First-chair trial counsel representing plaintiff telematics development company in $40 million arbitration against its primary distributor; obtained $40 million award and obtained confirmation of it in contested federal court proceedings.
    • Counseled global entertainment and gaming company regarding mass litigation arising from mass casualty event, including analyzing litigation strategies and settlement structures to maximize plaintiff participation, likelihood of court approval, and insurance coverage for pending and future claims.
    • Represented rape survivor in proceedings against national university and local fraternities.
