Intellectual Property Protection

The Theodora Oringher Intellectual Property Protection Group advises clients on the selection, protection, and enforcement of patents and trademarks both domestically and internationally.
Patent
Our patent attorneys assist clients in leveraging their intellectual property in the chemical, life sciences, medical technology, nanotechnology, telecommunications, and electrical and computer technology fields. We are experts in all facets of intellectual property counseling, including the preparation and prosecution of U.S. and foreign patent applications, patent portfolio management, freedom-to-operate and due diligence analyses, and non-infringement and invalidity opinions.
We help identify key intellectual property assets to both growing and established companies and develop strategies to generate value from these assets. We integrate ourselves with our clients’ business model by counseling and negotiating commercial and technology transactions, including, for example, partnerships, collaborations, and joint ventures, patent monetization and licenses, asset sales, outsourcing transactions, and manufacture, supply, and distribution agreements.
Trademark
Our trademark attorneys conduct United States and worldwide availability searches and provide clients with a practical, comprehensive analysis. We secure protection for traditional trademarks as well as trade dress of packaging and product designs, and nontraditional trademarks such as color and fragrance. Our trademark attorneys file applications for International Registration through the Madrid System, and we have a network of international counsel to assist us in registering and enforcing trademarks around the world. We provide efficient, cost-effective brand protection strategies with customized and flat-fee services. We also represent clients in need of legal services regarding licensing of intellecutal property.
USPTO Proceedings
The Theodora Oringher Intellectual Property Protection Group is also experienced representing patent owners in proceedings before the Patent Trial and Appeal Board (PTAB), including inter partes review (IPR), post-grant review (PGR), derivations, and interferences. Our attorneys further represent trademark owners in opposition and cancellation proceedings before the United States Trademark Trial and Appeal Board (TTAB), as well as proceedings under the Uniform Domain Name Dispute Resolution Policy (UDRP).
