Jason C. Hamilton

Senior Attorney

Jason Hamilton is a senior attorney in the Orange County office of Theodora Oringher. Jason's practice focuses on complex commercial business litigation, including intellectual property matters and class actions. He has meaningful stand-up trial experience and is experienced in all phases of litigation, including discovery, dispositive motions, trial, and appeals.

Jason has experience representing major food producers, residential services providers, and consumer product manufacturers in class actions alleging false advertising, fraud, misrepresentation, and unfair business practices, including claims under California’s unfair competition and false advertising laws: UCL (§17200), FAL (§17500), and CLRA (§1750).

In addition, Jason also has experience representing financial institutions and officers/directors in breach of contract, misrepresentation, accounting, lender liability, mortgage fraud, and RICO claims.

He also has experience representing generic pharmaceuticals and medical device manufacturers in intellectual property disputes, including patent cases, licensing disputes, and Hatch-Waxman ANDA litigation.

Jason serves on the Board of Directors of the Small Business Financial Development Corporation, Orange County. He previously served on Public Counsel’s Associate Leadership Board.

Jason actively participates in pro bono matters. He represented a class of inner-city elementary school students disproportionally affected by the Los Angeles Unified School District’s budgetary reductions in force, which led to a revision of the District’s layoff practices. Jason has also assisted individuals seeking asylum and legal status in the United States through the U-Visa process.

Jason received a B.A. in political science and history in 2006 from the University of California at Los Angeles and a J.D. in 2009 from UCLA School of Law, where he was a managing editor of the UCLA Law Review.

Prior to joining Theodora Oringher, Jason was an associate at Winston & Strawn in Los Angeles.

Representative Matters

  • Second-chaired a Hatch-Waxman ANDA trial on behalf of a major generic pharmaceutical company resulting in a complete victory invalidating the patents covering a blockbuster dry-eye treatment
  • Defeated a preliminary injunction on behalf of a medical device manufacturer in direct competitor litigation regarding spinal surgery access tools and implants
  • Defeated class certification on behalf of a major food producer in a series of class actions alleging false advertising and unfair completion based on alleged health and wellness claims made on product labels
  • Invalidated the patents covering manufacturing process for blockbuster opiate addiction treatments and opioid pain relievers on behalf of a major generic pharmaceutical company
  • Won pre-answer dismissal of all claims against a leading computer manufacturer in a case seeking equitable indemnification
  • Defended banks in cases alleging mortgage fraud, predatory lending practices, and breaches of contract, obtaining several pre-answer favorable judgments affirmed by the California Court of Appeals
  • Counseled a major generic pharmaceutical company regarding a new-product launch and avoidance of competitor litigation
  • Obtained dismissal with prejudice, affirmed by the Ninth Circuit, of RICO, fraud, false advertising, and unfair completion claims against individuals alleged to have participated in a Ponzi scheme
  • Defeated class certification on behalf of an exporter of nutritional supplements in claims alleging false advertising and unfair competition
  • Obtained a favorable early settlement for a consumer product manufacturer in a class action alleging misrepresentations regarding a product’s safety
  • Deafended a residential services provider against class-action claims of alleged unlicensed contracting
